Unprecedented court case against tobacco company in Georgia on 26th of October tobacco control alliance and lawyer Zaza Khatiashvili jointly held a press conference dedicated to an unprecedented court case. Mainly, case concerns citizen Giuli Chkhaidze’s civil complaint against tobacco producing company “OGT”, which has license from Philip Morris.
Mr. Chkhaidze is a consumer of production of this company “L&M” during the last years and he’s got serious heart and coronary diseases. He was operated and recommended to quit smoking after the operation but he was not able because of serious dependence on nicotine. Also victim requires concretely deliver information as a consumer regarding the smoking real harm. Furthermore he requires minimum 50% relevant medical warnings on cigarette packs including the pictorial warnings. Victim claims compensation as well.
During the press conference lawyer and alliance representatives gave interpretations to journalists regarding the all interesting questions for them. Lawyer said that Georgian court is not independent and are not sure that they will make fair decision. Lawyer is willing to complete all procedures timely in order to apply to European Court of Human Rights.
On 27th of October Tbilisi Civil Court of Civil Affairs on its first meeting held hearing of petitions of both parties. Petition of the representative from the victim’s side regarding the opening information about tobacco production containing nicotine and tar and also other chemical over, judge did not satisfy. To hold main meeting was appointed for 19th November.
